Form Outline

The TREC 15-7 form is organized into the following sections:

  1. Parties
    Names the buyer as Landlord and the seller as Tenant for the post-closing leaseback period.
  2. Lease
    Establishes the lease relationship and identifies the property by referencing the underlying sales contract address.
  3. Term
    Defines the lease period as starting at closing/funding and ending on a specified date, subject to the 90-day maximum and early termination provisions.
  4. Rental
    Establishes a daily rental rate with the total amount prepaid at closing. No refund is given for early termination caused by tenant default or voluntary move-out.
  5. Deposit
    Requires a security deposit paid at funding. The landlord must return the unused balance with an itemized deduction list within 30 days of the tenant surrendering possession and providing a forwarding address.
  6. Utilities
    Default is tenant pays all utilities. Any exceptions where the landlord pays must be specifically listed.
  7. Use of Property
    Restricts property use to residential purposes only and prohibits assignment or subletting.
  8. Pets
    Prohibits pets by default. Any allowed pets must be specifically described in the blank.
  9. Condition of Property
    As-is acceptance at start; return in contract-required condition minus normal wear and casualty loss.
  10. Alterations
    No alterations without written consent. Any installed improvements automatically become the landlord's property.
  11. Special Provisions
    Provides blank space for additional negotiated terms. Agents should use only factual business details and avoid legal language that could constitute unauthorized practice of law.
  12. Inspections
    Landlord has right to inspect at reasonable times; tenant must provide all keys and access codes.
  13. Laws
    Tenant must comply with all laws, HOA restrictions, ordinances, and regulations affecting the property.
  14. Repairs and Maintenance
    Places full repair and maintenance responsibility on the tenant, including landscaping. Tenant must promptly fix any damage caused by the tenant or their guests, unless the Texas Property Code requires otherwise.
  15. Indemnity
    Tenant holds landlord harmless from third-party injury/damage claims arising from tenant's occupancy, including legal costs.
  16. Insurance
    Both parties must maintain insurance. Critical warning that seller's post-closing occupancy may affect existing coverage for both parties.
  17. Default
    Establishes a very short 24-hour cure period after landlord's notice. If the tenant fails to begin remedying the default within 24 hours and diligently pursue the cure, the tenant is in default.
  18. Termination
    The lease ends either when the term expires (Paragraph 3 date) or immediately upon tenant default. These are the only two termination triggers.
  19. Holding Over
    Holdover creates a tenancy at sufferance with daily damages. The holdover rate is typically set higher than the standard daily rental to incentivize timely vacancy. The landlord retains all other legal remedies.
  20. Attorney's Fees
    A prevailing party clause that allows the winner of any lease-related legal proceeding to recover costs and attorney's fees from the losing party.
  21. Smoke Alarms
    Landlord must install smoke alarms per the Texas Property Code, but the tenant waives the landlord's ongoing duty to inspect and repair them during this short-term lease.
  22. Security Devices
    Exempts this lease from the Texas Property Code security device requirements because the lease term is 90 days or less.
  23. Consult Your Attorney
    Warns that agents cannot give legal advice and advises parties to consult an attorney if they do not understand the lease terms.
  24. Notices
    Requires all notices to be in writing. Notices are effective when mailed, hand-delivered, faxed, or emailed to the addresses provided in this section.
