Form Outline

The TREC 33-2 form is organized into the following sections:

  1. Header and Property Identification
    Identifies the form as a mandatory addendum required by the Texas Natural Resources Code, and ties it to the specific contract and property address.
  2. Boundary with Submerged Lands
    Puts the buyer on notice that the property shares a boundary with state-owned submerged lands, that this boundary can shift over time, and that the property owner may gain or lose land as a result. Only a state land surveyor can accurately establish the boundary.
  3. Prior Fill Disclosure
    Requires the seller to disclose any knowledge of prior fill (such as sand, soil, or other material placed on the property to raise elevation or extend land area). If the seller knows of any fill, they must describe it in the blank provided.
  4. Prohibition on Structures Over Submerged Lands
    Warns the buyer that Texas law forbids building, placing, or using any structures on state-owned submerged lands below the tide line unless proper governmental permission is obtained. This includes docks, piers, seawalls, and any other improvements.
  5. Advice to Seek Legal Counsel
    Strongly advises the buyer to consult an attorney or other qualified professional to understand the legal implications of the coastal property disclosures. Directs the buyer to the GLO Surveying Division for tide line location information.
  6. Signatures
    Provides signature lines for up to two buyers and two sellers. Includes the standard TREC disclaimer that the form is intended for use by trained licensees and is not suitable for complex transactions.
