Form Outline

The TREC 39-11 form is organized into the following sections:

  1. Header / Property Identification
    Identifies the property address that the underlying contract concerns. This ties the amendment to the specific contract being modified.
  2. Preamble
    Introductory statement establishing that the following checked items constitute the agreed-upon amendments to the contract.
  3. Sales Price Change
    Modifies the sales price of the property. Requires a full breakdown showing the cash portion the buyer brings to closing, the total financing amount, and the new total sales price (which must equal A + B).
  4. Additional Repairs and Treatments
    Adds specific repair and treatment obligations for the seller, at seller's expense, beyond what is already required by the contract. These are governed by Paragraph 7 of the contract regarding completion standards, documentation, and warranties.
  5. Closing Date Change
    Changes the closing date specified in Paragraph 9 of the contract to a new date.
  6. Seller Contribution Change - Paragraph 12A(1)(b)
    Changes the amount in Paragraph 12A(1)(b) of the contract — Seller's contribution toward Buyer's expenses OTHER than broker compensation. The 2026 revision clarifies that 12A(1)(b) is only for seller contributions to buyer expenses other than brokerage fees; compensation changes now belong in item (5) / Paragraph 12B.
  7. Brokerage Compensation Change - Paragraph 12B
    Changes the brokerage-compensation amounts in Paragraph 12B of the contract. The July 2026 contract revision moved all brokerage compensation into Paragraph 12B: 12B(1) lets the Seller contribute to the Buyer's broker's compensation, and 12B(2) (new) lets the Buyer contribute to the Seller's broker's compensation. Each party's amount is expressed as either a fixed dollar amount OR a percentage of the Sales Price — one box only per party.
  8. Lender Required Repairs Cost Allocation
    Allocates the cost of lender-required repairs and treatments between the seller and buyer. These are repairs that the lender requires as a condition of funding the loan, as documented in an attached itemized list.
  9. Option Period Extension
    Extends the buyer's option period (unrestricted right to terminate) in exchange for an additional option fee paid directly to the seller. The buyer can choose whether this additional fee will or will not be credited to the sales price at closing.
  10. Option Period Waiver
    The buyer irrevocably waives the unrestricted right to terminate the contract that was purchased with the option fee. Once this amendment is executed, the buyer can no longer terminate the contract without cause during the option period.
  11. Financing Approval Deadline Change
    Changes the deadline for the buyer to notify the seller that the buyer cannot obtain financing approval (Buyer Approval) as defined in the Third Party Financing Addendum.
  12. Other Modifications
    A catch-all section for any other modifications to the contract that are not covered by items (1) through (9). Contains an explicit warning that real estate brokers and sales agents are prohibited from practicing law.
  13. Legal Notice
    Standard TREC legal notice advising all parties to consult an attorney before signing and reminding licensees that they are prohibited from giving legal advice.
  14. Execution Block
    The signature and execution block where all parties sign the amendment and the broker records the date of final acceptance (the date the last party signs).
