Form Outline

The TREC 48-1 form is organized into the following sections:

  1. Header and Property Identification
    Identifies the property subject to the addendum and provides a bold-print advisory that both parties should consult a licensed plumber about the scope and risks of hydrostatic testing before signing.
  2. Authorization
    Grants the buyer permission to engage a licensed plumber to perform a hydrostatic plumbing test on the property. The buyer bears all costs of the testing regardless of which liability option is selected in Section B.
  3. Allocation of Risk
    Requires the parties to select one of three options for who bears liability for property damage caused by the hydrostatic test. The options range from full seller liability, to full buyer liability, to buyer liability capped at a negotiated dollar amount.
  4. Signatures
    Provides signature lines for up to two buyers and two sellers. All parties to the contract must sign to authorize the hydrostatic test and agree to the liability allocation.
