Form Outline

The TREC 49-1 form is organized into the following sections:

  1. Header and Property Identification
    Identifies the property and establishes that the Third Party Financing Addendum is attached. Confirms the transaction does not involve FHA or VA financing.
  2. Waiver
    Complete waiver of the buyer's appraisal termination right. The buyer agrees not to terminate if the property appraises low and must cover any financing gap with additional cash.
  3. Partial Waiver
    Conditional waiver that preserves the buyer's termination right if the appraisal falls below a specified minimum value. Provides a middle-ground compromise between full waiver and full contingency protection.
  4. Additional Right to Terminate
    Grants the buyer an extra termination right with a specific deadline and minimum appraisal value. This is buyer-favorable and supplements (does not replace) the existing Paragraph 2B rights.
  5. Signatures
    Provides signature lines for up to two buyers and two sellers to execute the addendum.
