Form Outline

The TREC 57-0 form is organized into the following sections:

  1. Header and Property Identification
    Identifies the form and links it to the main contract by property address. Notes TREC approval for voluntary use.
  2. Personal Property Conveyance and Consideration
    Sets the additional dollar amount the buyer pays for the personal property and requires a detailed itemized list of every item being conveyed. Items must be described with specificity including description, model numbers, serial numbers, and location.
  3. Seller's Warranty of Ownership
    The seller provides a representation and warranty that they own all listed personal property items free and clear of all encumbrances such as liens, security interests, or third-party claims.
  4. Disclaimer of Warranty on Condition
    The seller expressly disclaims any warranty or guarantee regarding the condition or future performance of the personal property. All items are conveyed as-is, placing the risk of defects or failure on the buyer after closing.
  5. Signatures
    Signature block for all buyers and sellers to execute the addendum. Both parties must sign for the addendum to be binding and become part of the contract.
