Form Outline

The TREC 59-0 form is organized into the following sections:

  1. Header and Instructions
    Provides instructions about form priority: use the district's own form if available, otherwise complete this TREC form with information obtained from the district.
  2. Name of Special District
    Identifies the special taxing or assessment district by its official name and notifies the buyer that the property may be subject to district taxes or assessments.
  3. Tax Rate
    Discloses the district's current or projected property tax rate per $100 of assessed valuation. Notes the district may impose an unlimited tax rate to repay bonds, subject to voter approval.
  4. Assessments
    Discloses any assessments the district imposes, whether as a rate per $100 of assessed valuation or a specific dollar amount on the property. Also covers projected assessments for districts that have not yet imposed them.
  5. Bonds
    Discloses bonds approved by voters and bonds actually issued, organized by infrastructure category (water/sewer/drainage, roads, parks/recreation, and other). Distinguishes between voter-approved bond authorization and bonds actually issued.
  6. Standby Fees
    Discloses any standby fees the district has been authorized to impose by the TCEQ. Unpaid standby fees create a personal obligation on the property owner and a lien on the property.
  7. Location
    Discloses the district's geographic relationship to nearby municipalities, specifically whether it falls within a city's extraterritorial jurisdiction or corporate boundaries, which affects annexation and taxation.
  8. Strategic Partnership Agreement
    Discloses whether the district has a strategic partnership agreement with a municipality that may govern the terms and timeline of future annexation.
  9. Purpose of District
    Identifies the types of facilities and services the district provides. Warns the buyer that district facility costs are not included in the property purchase price.
  10. Disclaimer and Signatures
    Warns that district information changes annually and buyers should verify directly with the district. Provides signature lines for all parties and the buyer's acknowledgment of receipt.
