Form Outline

The TXR 1404 form is organized into the following sections:

  1. Header and Property Identification
    Identifies the form, restricts use to TXR members, and provides a blank for the property address. Defines 'Owner' as seller or landlord.
  2. Effective Date
    Sets the effective date for when the amendments take effect. Both owner and broker must agree to the date.
  3. Listing Price Change
    Allows the owner and broker to change the listing price specified in Paragraph 3 of the original listing agreement.
  4. Listing Expiration Date Change
    Allows the owner and broker to change the listing expiration date in Paragraph 4 of the original listing agreement.
  5. Broker's Fee Change
    Allows modification of the broker's fee. This section applies ONLY to TXR 1101 (residential) and TXR 1201 (commercial) listing agreements. The fee can be expressed as a percentage of sales price, a flat fee, or other terms.
  6. Cooperating Broker Compensation Change
    Allows modification of the compensation offered to the cooperating (other) broker. Applies only to TXR 1101 and TXR 1201 listing agreements, referencing Paragraph 5A2.
  7. Marketing Pause Instructions
    Allows the owner to instruct the broker to temporarily stop marketing the property while keeping the listing active. Marketing resumes either upon further instructions from the owner or on a specified date.
  8. Other Paragraph Changes
    A catch-all provision that allows the parties to amend any other paragraph(s) of the listing agreement not covered by sections A through E.
  9. Compensation Disclaimer
    Bold legal disclaimer stating that all broker compensation is fully negotiable and not fixed or controlled by any association, MLS, or listing service.
  10. Signature Block
    Signature block for the broker (or broker's associate) and owner(s). The broker must provide a license number. Multiple owners each get a signature line.
