Form Outline

The TXR 1405 form is organized into the following sections:

  1. Header and Addressee
    Identifies the owners association to which the request is being sent, including their name and mailing address.
  2. Notice of Intended Sale/Purchase
    Notifies the owners association that the sender intends to sell or purchase a specific property within the association and formally requests required information.
  3. Type of Information Requested
    Specifies whether the request is for residential subdivision information (restrictions, bylaws, resale certificate per Section 207.003) or condominium information (declaration, bylaws, resale certificate per Section 82.157). Only sellers may request condominium information.
  4. Delivery Instructions
    Specifies the person and address where the owners association should deliver the requested information, including contact details and the role of the recipient.
  5. Statutory Delivery Requirement and Right of First Refusal
    Reminds the owners association of the statutory 10-business-day delivery requirement under the Texas Property Code and requests disclosure of any right of first refusal or additional information requirements.
  6. Enclosed Payment
    Provides a space to indicate the amount of payment enclosed to cover the owners association's fee for providing the requested information.
  7. Signatures
    Signature lines for the owner and/or buyer, along with dates, to authenticate the request.
  8. Enclosure Note
    Indicates that the appropriate TREC Resale Certificate form should be enclosed with this request -- TXR 1921 for condominiums or TXR 1923 for subdivisions.
