TXR 1504 — Notice from Buyer's Agent to Seller

This notice is delivered by a buyer's agent to a seller when the seller's own broker has asked the buyer's agent to deliver an offer. It discloses to the seller that the agent represents the buyer, not the seller, that any material information the seller provides will be passed to the buyer, and it lists the services the buyer's agent will NOT provide to the seller, encouraging the seller to contact their own broker or attorney.

Form Outline

The TXR 1504 form is organized into the following sections:

  1. To / From / Re / Date
    The seller the notice is addressed to, the buyer's broker delivering it, the property, and the date of the notice.
  2. A. Delivery of the Enclosed Offer
    Printed text: "Your real estate broker has asked that I deliver the enclosed offer to you."
  3. B. My Client
    Printed text: "My client is the prospective buyer(s)."
  4. C. Material Information
    Printed text: "I am obliged to inform my client of any material information you provide to me."
  5. D. I Will Not Provide You With
    Printed text listing the seven things the buyer's agent will NOT provide the seller: (1) opinions or advice; (2) assistance in evaluating any offer; (3) assistance in drafting any offer, response, disclosure, notice, or other information; (4) relevant market information; (5) information related to any contractual duty; (6) assistance in arranging for the completion of any obligations under a contract; (7) information related to other service providers.
  6. E. Contact Your Broker or Attorney
    Printed text encouraging the seller to contact their broker or attorney, noting that TREC Rules obligate a broker under a listing agreement to negotiate the best possible transaction for the principal (seller).
  7. Broker Compensation Disclaimer
    Printed text: broker compensation is not set by law nor fixed, controlled, recommended, or suggested by the Association of REALTORS®, MLS, or any listing service; it is fully negotiable and brokers independently determine their fees.
