Form Outline

The TXR 1504 form is organized into the following sections:

  1. Header Information
    Identifies the parties and property involved in the notice: the seller receiving it, the buyer's broker delivering it, the property address, and the date.
  2. Purpose of Delivery
    States that the seller's own broker has asked the buyer's agent to deliver the enclosed offer.
  3. Client Disclosure
    Discloses that the agent's client is the buyer, not the seller.
  4. Material Information Obligation
    Warns the seller that anything they tell the buyer's agent will be communicated to the buyer.
  5. Services NOT Provided
    Explicitly lists seven categories of services the buyer's agent will NOT provide to the seller: opinions/advice, offer evaluation, drafting assistance, market information, contractual duty information, obligation completion assistance, and service provider referrals.
  6. Recommendation to Seek Counsel
    Encourages the seller to contact their own broker or attorney and reminds them that TREC rules require their listing broker to negotiate in their best interest.
  7. Broker Compensation Disclaimer
    A prominent disclaimer stating that broker compensation is fully negotiable and not set or controlled by any association, MLS, or listing service.
