  1. PARTIES
    Identifies the Client (buyer or tenant) and the Broker who are entering into this representation agreement.
  2. APPOINTMENT
    Formally appoints the Broker as the Client's real estate agent, establishing the agency relationship.
  3. DEFINITIONS
    Defines two key terms: 'acquire' (purchase or lease) and 'market area' (the geographic area in Texas where the broker will represent the client).
  4. TERM
    Sets the start and end dates for the representation agreement. The agreement automatically expires at 11:59 p.m. on the end date.
  5. BROKER OBLIGATIONS
    Defines the broker's obligations and offers two service levels: Full Services (best-efforts representation) or Showing Services (property access only for a flat fee). Under Showing Services, the client obligations, compensation, and intermediary paragraphs do not apply.
  6. CLIENT OBLIGATIONS
    Establishes the client's exclusive obligations: work only through this broker in the market area and inform all other parties that this broker is their exclusive representative.
  7. BROKER COMPENSATION
    Details the broker's compensation structure including: fee amounts for purchases and leases, when fees are earned (contract execution) vs. payable (closing or client breach), the source of payment (seller/landlord contributions credited toward client obligation), and escrow authorization for fee collection.
  8. INTERMEDIARY
    Addresses whether the client authorizes the broker to act as an intermediary when the client wants to acquire one of the broker's own listings. Includes the required statutory disclosures about intermediary duties and restrictions on confidential information.
  9. Compensation Disclosures and Legal Notices
    Contains required legal disclosures: compensation is negotiable and not set by any association, broker cannot exceed stated compensation from any source, the agreement is legally binding, attorney consultation is recommended, and electronic signatures are authorized.
  10. Signatures
    Signature block for the broker (or broker's associate), with license numbers, and up to two clients with their signatures and dates.
