Form Outline

The TXR 1939 form is organized into the following sections:

  1. Header and Contract Identification
    Identifies the sender and recipient of the termination notice (buyer or seller), the property address, and the effective date of the contract being terminated.
  2. Termination Under Paragraph 7B (Feasibility Period)
    Buyer terminates under Paragraph 7B (feasibility period) and requests earnest money refund. Seller retains independent consideration per the contract.
  3. Termination Under Other Contract Paragraph
    Terminates the contract under a specified paragraph other than 7B. The paragraph number must be filled in.
  4. Release of Earnest Money
    Attaches an earnest money release form and provides instructions for its delivery to the escrow agent, either through a specified contact person or directly by the recipient.
  5. Other
    Open text area for additional termination-related information, explanations, or requests.
  6. Signature Block
    Signature blocks for up to two signatories with entity name, signature, printed name, title, and date lines. Only the terminating party signs.
