Form Outline

The TXR 2015 form is organized into the following sections:

  1. Header and Disclaimer
    Identifies the property and prominently disclaims that the addendum is solely a disclosure of the landlord's current knowledge, not a warranty or prediction. This disclaimer is printed in bold on the form.
  2. 100-Year Floodplain
    Requires the landlord to disclose whether they are aware the property is in a 100-year floodplain. If neither box is checked, the tenant should assume floodplain location. Advises tenants that properties outside floodplains may still flood, that FEMA has free online flood maps, and that most tenant insurance does NOT cover flood damage.
  3. Damage to a Dwelling Due to Flooding During the Last Five-Year Period
    Requires the landlord to disclose whether they are aware the dwelling has flooded at least once within the last five years.
  4. Definitions
    Provides statutory definitions for '100-year floodplain' (1% or greater annual chance of flooding per FEMA) and 'flooding' (inundation from overflow of waters, unusual runoff/surface water accumulation, or excessive rainfall). Notes the elevation exemption for the floodplain disclosure.
  5. Tenant Acknowledgement
    The tenant acknowledges that they have received the flood disclosure notice.
  6. Signatures
    Signature blocks for up to two landlords and up to four tenants, each with corresponding dates.
