TREC 56-0Addendum for Seller's Disclosure of Information on Lead-Based Paint and Lead-Based Paint Hazards as Required by Federal Law

Fulfills the federal disclosure requirements under 42 U.S.C. 4852d and EPA/HUD regulations (24 CFR Part 35 and 40 CFR Part 745) for residential dwellings built before 1978: the seller discloses known lead-based paint / hazards and available records, the buyer elects to waive or keep a 10-day inspection right (with a 14-day termination right), and acknowledges receipt of the EPA pamphlet. Form Outline

The TREC 56-0 form is organized into the following sections:

  1. Header and Property Identification
    Identifies the property address and links the addendum to the underlying purchase contract.
  2. A. Lead Warning Statement
    Preprinted federal warning about the potential presence of lead-based paint in pre-1978 residential properties. Nothing to fill in.
  3. B. Seller's Disclosure
    The seller discloses actual knowledge of lead-based paint / hazards (B.1) and whether any records or reports are available (B.2). Each is "check one box only".
  4. C. Buyer's Rights
    Check one box only: the buyer either waives the lead-based paint risk assessment / inspection, or keeps the right to inspect within 10 days after the effective date and terminate within 14 days if hazards are found.
  5. D. Buyer's Acknowledgment
    Check applicable boxes: buyer confirms receipt of the seller-provided information and the EPA pamphlet.
  6. E. Brokers' Acknowledgment
    Preprinted: both brokers confirm they informed the seller of the federal obligations under 42 U.S.C. 4852d. Nothing to fill in.
  7. F. Certification of Accuracy and Signatures
    Buyers, sellers, and both brokers sign and date, certifying the accuracy of the information they provided. Signatures and dates are collected by e-signature.
