TREC 61-0 — Seller's Disclosure About Groundwater and Surface Water Rights

The Seller's Water Disclosure required by Paragraph 7I of the 2026 TREC contracts: Seller's knowledge, as of the date signed, about groundwater districts, water wells (count, use, permits, ownership and agreements), water received from wells on other property, groundwater rights owned or leased from outside the property or severed/sold/leased, TCEQ surface water rights, and any pond, lake or water tank. Not a warranty or a substitute for inspections. Sellers sign; Buyers acknowledge receipt.

Form Outline

The TREC 61-0 form is organized into the following sections:

  1. Property
    This notice is a disclosure of Seller's knowledge about groundwater and surface water rights on the Property as of the date signed by Seller. It is not a substitute for inspections or warranties and is not a warranty of any kind by Seller or Seller's agents.
  2. 2A. Groundwater District
    A Groundwater District is a local or regional Groundwater Conservation District, Underground Water Conservation District, Subsidence District, or other special district or authority that regulates the drilling or operation of Water Wells. Not all land in Texas is subject to one.
  3. 2B. Water Wells on the Property
    A Water Well is an artificial excavation drilled or dug to explore for or produce groundwater. Attach additional sheets as necessary.
  4. 2C. Ownership and Operation of the Water Wells
    If the answer to 2B is yes, complete the following to the extent known.
  5. 2D. Water From a Well on Another Property
    Not including water from a city, municipal utility district or other special district, water supply corporation, or private water company.
  6. 2E. Groundwater Rights From Outside the Property
  7. 2F. Severed, Sold, or Leased Groundwater Rights
  8. 3A. Surface Water Rights
    A Surface Water Right is a permit, certified filing, or certificate of adjudication administered by the Texas Commission on Environmental Quality (TCEQ) that authorizes the diversion, impoundment, or use of Surface Water. Not all diversions, impoundments, or uses require one.
  9. 3B. Pond, Lake, or Water Tank
  10. Signatures
    Sellers sign and date the disclosure; Buyers sign and date to acknowledge receipt. Both parties initial page 1 for identification.
