TXR 1423 — Amendment to Residential Listing, Exclusive Right to Lease

A one-page amendment to a TXR 1102 Residential Listing (Exclusive Right to Lease): change the listing price (monthly rental and lease term range), the date the listing ends, the broker's fee, the compensation paid to the other broker, instruct the broker to cease and resume marketing, or change any other paragraph. Signed by the broker (or broker's associate) and the Landlord.

The TXR 1423 form is organized into the following sections:

  1. Property
    "Amendment to Listing Agreement between the undersigned parties concerning the Property at ______." This form shall only be used to amend TXR 1102.
  2. Effective Date
    "Effective ______, Landlord and Broker amend the above-referenced Listing as follows:"
  3. A. Listing Price and Lease Term (Paragraph 3)
    "❑ A. The LISTING PRICE in Paragraph 3 is changed and Broker is instructed to market the Property: A. at a monthly rental of $______ (Listing Price); and B. for a lease term of not less than ______ months and not more than ______ months."
  4. B. Term (Paragraph 4A)
    "❑ B. The TERM in Paragraph 4A is changed and the Listing shall end on ______ at 11:59 p.m."
  5. C. Broker's Fee (Paragraph 5A(1) or 5B)
    "❑ C. The BROKER’S FEE in Paragraph ❑5A(1) or ❑5B is changed as follows: ❑ (a) ___% of one full month’s rent to be paid under a lease of the Property. ❑ (b) ___% of all rents to be paid under a lease of the Property. ❑ (c) ______."
  6. D. Other Broker's Compensation (Paragraph 5A(2))
    "❑ D. The compensation paid to the other broker in Paragraph 5A(2) is changed as follows: (complete only one) ❑ ___% of one month’s rent to be paid under a lease. ❑ ___% of all rents to be paid under a lease. ❑ A flat fee of $______."
  7. E. Cease and Resume Marketing
    "❑ E. Landlord instructs Broker to cease marketing the Property on ______ and resume marketing the Property on: ❑ (1) receipt of further instructions from Landlord; or ❑ (2) ______. The Listing is not terminated and remains in effect for all other purposes."

  9. Compensation Disclaimer
    Bold preprinted statement: compensation paid to brokers or shared between brokers is not set by law nor fixed, controlled, recommended, or suggested by the Association of REALTORS®, any MLS, or any other listing service; it is fully negotiable and each broker independently determines their fees. No blanks.
  10. Signatures
    Left column: Broker's Printed Name / License No., Broker's (❑ or Broker's Associate's) Signature / Date, Broker's Associate's Printed Name, if applicable / License No. Right column: two Landlord's Printed Name and Landlord's Signature / Date pairs.
